These Terms of Service ("Terms") govern your use of the Poker Ascent application and website ("Service") operated by Poker Ascent ("we," "us," "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. The Service
Poker Ascent is a poker training application that provides educational drills, coaching explanations, progress tracking, and decision-making exercises. The Service is designed to help users improve their poker skills through deliberate practice.
Poker Ascent is NOT a gambling service. We do not offer real-money poker, betting, wagering, or any form of gambling. No real money is won or lost through gameplay within the app. The Service is purely educational.
2. Eligibility
- You must be at least 18 years old to use Poker Ascent
- By creating an account, you represent and warrant that you are at least 18 years of age
- You must provide accurate, current, and complete information during registration
- You are responsible for maintaining the security of your account credentials
3. Accounts
- One account per person — duplicate or shared accounts may be terminated
- You are responsible for all activity that occurs under your account
- Notify us immediately if you suspect unauthorized access to your account
- You may delete your account at any time from your profile settings
- We reserve the right to suspend or terminate accounts that violate these Terms
4. Subscription Plans and Payment
4.1 Free Plan
The free plan includes a daily drill quota, beginner and intermediate skill tiers, streak tracking, XP, and basic progress tracking.
4.2 Premium Plan
The premium plan includes unlimited drills, all skill tiers (advanced, expert, infinite mode), full progress tracking, premium power-ups, and all future premium features.
4.3 Billing
- Web purchases: Processed through Stripe. Subscriptions auto-renew at the end of each billing period (monthly or annually) unless cancelled.
- In-app purchases (iOS/Android): Processed through Apple App Store or Google Play Store. Subject to their respective billing terms, refund policies, and pricing.
- Prices are displayed in your local currency and may vary by platform
- We reserve the right to change subscription pricing with 30 days' notice
4.4 Cancellation
- You may cancel your subscription at any time
- Access continues until the end of your current billing period
- No partial refunds for unused portions of a billing period
- After cancellation, your account reverts to the free plan

5. Educational Content Disclaimer
Poker Ascent provides poker strategy education based on commonly accepted principles, population-level tendencies, and established poker theory. Important disclaimers:
- Our drills teach decision-making frameworks — they are not guarantees of winning at poker
- Correct answers may vary depending on specific game conditions, opponent reads, and dynamics not captured in a drill scenario
- Poker involves inherent variance — optimal decisions can still result in short-term losses
- Training mode preferences (balanced, exploitative, aggressive, conservative) provide different but valid approaches to the same situations
- We are not responsible for any financial losses incurred while playing real-money poker
- Past performance in drills does not predict future results at real poker tables
6. User Data and Content
6.1 Your Data
By using the Service, you grant us a worldwide, non-exclusive, royalty-free license to use, process, and analyze your gameplay data (drill answers, accuracy, decision patterns) in anonymized, aggregated form for:
- Improving our training content and algorithms
- Conducting poker strategy research
- Creating anonymized, aggregated datasets about player decision patterns
- Publishing research or insights derived from aggregated data
This license does not include the right to identify you personally in any published research or shared data.
6.2 Data Usage Rights
You retain ownership of your personal account information. Anonymized, aggregated gameplay data (which cannot identify you) may be used commercially, including for research publications, content creation, and data licensing.
7. Acceptable Use
You agree not to:
- Reverse-engineer, decompile, or disassemble any part of the Service
- Scrape, crawl, or automatically extract drill content, explanations, or training algorithms
- Use automated tools, bots, or scripts to interact with the Service
- Share your account credentials with others or operate multiple accounts
- Attempt to manipulate XP, streaks, progress data, or leaderboard positions
- Redistribute, republish, or commercially exploit our drill content without written permission
- Use the Service for any illegal purpose or in violation of any applicable laws
- Interfere with or disrupt the Service's infrastructure or other users' experience
8. Intellectual Property
- All content in Poker Ascent — including drills, explanations, training algorithms, coaching methodology, UI design, and brand assets — is owned by Poker Ascent and protected by intellectual property laws
- The Poker Ascent name, logo, and visual identity are trademarks of Poker Ascent
- You may not reproduce, distribute, modify, or create derivative works from our content without prior written permission
- Screenshots of your own progress and results may be shared for personal, non-commercial use
9. Termination
- You may terminate your account at any time by deleting it in your profile settings
- We may suspend or terminate your account for violations of these Terms, with or without notice
- Upon termination, your right to use the Service ceases immediately
- Provisions that should survive termination (intellectual property, limitation of liability, data rights) will remain in effect
10. Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
We do not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- The drill content or strategy advice will guarantee poker success
- Any errors in the Service will be corrected
11. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, POKER ASCENT AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Any loss of profits, data, or business opportunities
- Financial losses from real-money poker play, regardless of whether such play was informed by training from the Service
- Any damages exceeding the amount you paid us in the 12 months preceding the claim
12. Indemnification
You agree to indemnify, defend, and hold harmless Poker Ascent and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, violation of these Terms, or violation of any third-party rights.
13. Dispute Resolution
- Any disputes arising from these Terms or the Service will be resolved through binding arbitration, except for claims that qualify for small claims court
- Arbitration will be conducted under the rules of the American Arbitration Association
- You agree to resolve disputes on an individual basis — class actions and class arbitrations are not permitted
- These Terms are governed by the laws of the United States
14. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by posting a notice in the app and updating the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the updated Terms.
15. General
- If any provision of these Terms is found unenforceable, the remaining provisions remain in effect
- Our failure to enforce any right or provision does not constitute a waiver
- These Terms constitute the entire agreement between you and Poker Ascent regarding the Service
- You may not assign or transfer these Terms without our consent; we may assign them freely
